Terms and Conditions
Last updated: September 13, 2026
1. About these terms
These Terms and Conditions ("Terms") govern all quotations, orders and sales of goods by fireworktubes.com ("we", "us", "our") to a business customer ("you", "the Buyer"). Our factory operates from Jiangxi, China, and we sell to trade customers worldwide.
We sell to businesses only. Our products are industrial components intended for licensed manufacturers and professional display companies. They are not consumer products and must not be resold to the general public as finished fireworks.
By requesting a quotation, placing an order, or accepting delivery of our goods, you agree to these Terms. If you use your own purchase terms, they apply only where we have confirmed them in writing.
2. Definitions
- Goods — molded firework tubes and related components we manufacture and supply.
- Order — a request from you to buy Goods, confirmed by us in writing.
- Specification — the drawing, sample or written dimensions agreed for your Order.
- Incoterms — the Incoterms® 2020 rules of the International Chamber of Commerce.
3. Quotations
We aim to reply to every enquiry within 24 hours. Quotations are issued in US dollars unless stated otherwise and are valid for 30 days from the date of issue, unless a different period is written on the quotation. Quotations are based on the quantities, Specification and destination stated in your enquiry; changes to any of these may change the price.
4. Orders and acceptance
An Order is accepted only when we confirm it in writing (email or proforma invoice). We may decline an Order, or ask for revised terms, where quantities, packaging or delivery dates cannot be met. Minimum order quantity is 1,000 pieces per size for stock moulds; custom moulds start at 5,000 pieces unless agreed otherwise.
5. Prices, currency and payment
- Prices are quoted FOB Shanghai / Ningbo by default. CIF and DDP can be quoted on request.
- Unless agreed otherwise, payment terms are 30% deposit by T/T with order confirmation, 70% balance against a copy of the bill of lading. We also accept L/C at sight for large orders.
- Bank charges outside China are the Buyer's responsibility.
- We may suspend production or shipment where payment is overdue, without affecting our other rights.
6. Samples
Samples of stock sizes are provided free of charge; the Buyer covers the courier cost. Where a new mould is required, sample scope, cost and lead time are agreed in writing with your enquiry.
7. Specification and tolerances
Goods are produced to the Specification you approve. Molded tubes are manufactured to controlled dimensional tolerances; the exact figures are confirmed against your drawing. Small variations in colour, surface finish and shade are inherent to molded production and are not defects.
8. Delivery, risk and title
Delivery terms follow the Incoterms® 2020 rule stated in our order confirmation. Under FOB, risk passes to the Buyer when the Goods are loaded on board at the named Chinese port; the Buyer arranges and pays for main-carriage freight and insurance. Title passes when we have received payment in full. Delivery dates are good-faith estimates; see our Delivery Terms for lead times and loading details.
9. Quality, inspection and claims
Every batch is pressure-tested and dimensionally checked before packing, and a batch test report is provided with each shipment. Third-party inspection (for example SGS or BV) can be arranged on request at the Buyer's cost.
Claims must be notified in writing:
- Visible damage or shortage — within 7 days of delivery, with photographs of the goods and packaging.
- Hidden defects or dimensional issues — within 30 days of delivery, with photographs, measurements and the batch reference.
Where a claim is accepted, our liability is limited to replacing the affected Goods or issuing a credit note for them, at our option. Goods must be stored in dry conditions; we are not responsible for defects caused by storage, handling, misuse, or by assembly and firing processes carried out by others.
10. Buyer responsibilities and compliance
You are responsible for:
- holding all licences, permits and authorisations required in your country for manufacturing, storing, selling or using fireworks and fireworks components;
- ensuring the Goods comply with the regulations of your destination market (for example EN 15947 in the EU, or the applicable national standard elsewhere);
- confirming the transport classification and any import documentation with your freight forwarder and authorities;
- loading, storing and using the Goods safely and in accordance with applicable law.
Our tubes are non-explosive components. They contain no pyrotechnic composition, and we do not supply finished fireworks.
11. Intellectual property
You confirm that you own or are licensed to use any logo, artwork, brand name or design you ask us to apply to the Goods, and you indemnify us against third-party claims arising from them. Moulds, tooling, drawings and production know-how we create remain our property unless we agree in writing to transfer them.
12. Confidentiality
Each party will keep the other's confidential information (including designs, drawings, prices and customer details) confidential and use it only to perform the contract. This obligation continues for three years after the business relationship ends.
13. Limitation of liability
To the extent permitted by law, our total liability arising from any Order is limited to the invoice value of the affected Goods. We are not liable for indirect or consequential losses, including loss of profit, loss of production, penalties or third-party claims. Nothing in these Terms limits liability that cannot lawfully be limited.
14. Force majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, epidemics, war, strikes, government action, port congestion, container shortages, or fire or explosion at a supplier's premises. Where such an event continues for more than 60 days, either party may cancel the affected Order without liability, and payments for Goods already produced remain due.
15. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China. The parties will first try to resolve any dispute through good-faith negotiation. If it is not resolved within 30 days, the dispute will be referred to the China International Economic and Trade Arbitration Commission (CIETAC) for arbitration in Shanghai, or to the competent court at our place of business, as agreed in the order confirmation. The language of proceedings is English.
16. Changes and severability
We may update these Terms from time to time; the version published on this page applies to Orders placed after it is published. If any provision is found unenforceable, the remaining provisions stay in force.
